U.S. Solicitor General Noel Francisco has asked the Supreme Court to review a decision by the Court of Appeals for the Fourth Circuit that vacated permits for Dominion Energy Inc.’s $7.5 billion Atlantic Coast pipeline, according to Bloomberg.
In its previous ruling, the appeals court determined the U.S. Forest Service violated the National Forest Management Act when it granted permits for the Atlantic Coast Pipeline, stating the agency lacked the authority to make the decision. However, in his recent filing to the Supreme Court, Francisco argued that the appeals court misread the National Trails System Act.
Since the beginning, the Atlantic Coast has seen its start date delayed and its price tag grow. Even still, Dominion, which is developing Atlantic Coast with Duke Energy Corp. and Southern Co., has stuck to the plan despite the setbacks.
